<br />Special Called Meeting, Public Hearing and Workshop Meeting 5-19-08 <br /> <br />4 <br /> <br />12. Public Hearing- Council to consider recommendation of Planning and Zoning Commission <br />to approve an ordinance amending Chapter 106 (Zoning) to add the maximum height <br />restriction for commercially zoned and high density residentially zoned properties when <br />adjacent to low density residentially zoned properties. <br /> <br />Open Public Hearing - Mayor Porter opened the Public Hearing at 7:29 p.m. <br /> <br />Planning Director Tim Teitjens presented summary and recommendation and answered <br />Council's questions. <br /> <br />Public Input - Phillip Hoot, 927 Seabreeze is against rezoning. <br />Lester Quinn, 1211 Bayshore Dr. is against rezoning. <br />Bobby Schlenk- 620 S. 4th is against rezoning. <br />Ed Matuszak, 10443 Catlett, is opposing the ordinance as written. <br />Ted Powell, 1700 Roscoe is against rezoning. <br />Ronda Lunsford, 201 E. Main St. is against rezoning. <br />Kathryn Aguilar, 3119 Fondren is against rezoning. <br /> <br />The Public Hearing was closed at 7:43 p.m. <br /> <br />Recommendation of Planning & Zoning Commission - City Council consider <br />approval of Ordinance amending Chapter 106 of the Code of Ordinances of the City of <br />La Porte by adding footnote #9 Sections 106-443, Table B, "Commercial area <br />Requirements", that the maximum allowable height for structures within commercially <br />zoned and high density residentially zoned properties when adjacent to low density <br />residentially zoned properties is 30 feet. <br /> <br />13. Council to consider approval or other action regarding Ordinance 1501-C6. <br /> <br />Assistant City Attorney Clark Askins read: Ordinance 1501-C6- AN ORDINANCE <br />AMENDING THE CODE OF ORDINANCES OF THE CITY OF LA PORTE, CHAPTER <br />106, MORE COMMONLY REFERRED TO AS THE ZONING ORDINANCE OF THE CITY <br />OF LA PORTE, BY AMENDING ARTICLE III. "DISTRICTS", DIVISION 3 "COMMERCIAL <br />DISTRICT REGULATIONS", SUBDIVISION I, "GENERALLY", BY ADDING FOOTNOTE <br />#9 TO SECTION 106-443, TABLE B. "COMMERCIAL AREA REQUIREMENTS", <br />PERTAINING TO MAXIMUM HEIGHT RESTRICTIONS FOR STRUCTURES LOCATED <br />WITHIN 120 FEET OF RESIDENTIALLY ZONED PROPERTY; MAKING CERTAIN <br />FINDINGS OF FACT RELATED TO THE SUBJECT; FINDING COMPLIANCE WITH THE <br />OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF; <br /> <br />Motion as made by Councilmember Clausen to approve Ordinance 1501.C6 as <br />recommended by Mr. Teitjens. Councilmember Ebow second. The motion carried. <br /> <br />Ayes: Mosteit, Mayor Pro-Tem Rigby, Moser, Black, Malone, Clausen, Ebow, Engelken <br />and Porter <br />Nays: None <br />Abstain: None <br />
