<br />ORDINANCE NO. 2008 -, 30 ~ ~ <br /> <br />AN ORDINANCE AMENDING CHAPTER 70 "TRANSPORTATION", <br />ARTICLE III "OPERATION OF VEHICLES", DIVISION 2 "SPEED <br />LIMITS", BY AMENDING SECTIONS 70-101 AND 70-106 OF THE CODE <br />OF ORDINANCES OF THE CITY OF LA PORTE FOR THE PURPOSE <br />OF DESIGNATING MAXIMUM SPEED LIMITS ON STATE HIGHWAY <br />146 MAIN LINE AND STATE HIGHWAY 146 FRONTAGE ROADS, <br />WITHIN THE CITY OF LA PORTE; PROVIDING A REPEALING CLAUSE; <br />CONTAINING A SEVERABILITY CLAUSE; FINDING COMPLIANCE WITH <br />THE OPEN MEETINGS LAW; PROVIDING THAT ANY PERSON VIOLATING <br />THE TERMS OF THIS ORDINANCE SHALL BE DEEMED GUILTY OF A <br />MISDEMEANOR AND UPON CONVICTION SHALL BE FINED IN A SUM <br />NOT TO EXCEED TWO HUNDRED DOLLARS; PROVIDING FOR THE <br />PUBLICATION OF THE CAPTION HEREOF; AND PROVIDING AN <br />EFFECTIVE DATE. <br /> <br />WHEREAS, Section 545.356, Vernon's Texas Civil Statutes, provides that <br />whenever the governing body of the City of La Porte shall determine upon the basis of an <br />engineering and traffic investigation that any prima facie speed therein set forth is greater <br />or less than is reasonable or safe under the conditions found to exist at any intersection or <br />other place or upon any part of a street or highway within the City of La Porte, taking <br />into consideration, but not limited to, the width and condition of the pavement and other <br />circumstances on such portion of said street or highway, as well as the usual traffic <br />thereon, said governing body may determine and declare a reasonable and safe prima <br />facie speed limit thereat or thereon by passage of an ordinance, which shall be effective <br />when appropriate signage giving notice thereof is erected at such intersection or other <br />place or part of the street or highway; and <br /> <br />WHEREAS, the State of Texas has directed that an Engineering and Traffic <br />Investigation take place for the purpose of ascertaining reasonable and prudent prima <br />facie speed limits on State Highway 146 Main Line and State Highway 146 Frontage <br />Roads, within the City of La Porte; <br /> <br />WHEREAS, upon the basis of an engineering and traffic investigation heretofore <br />made as authorized by Section 545.356, Vernon's Texas Civil Statutes, the following <br />prima facie speed limits hereafter indicated for vehicles are hereby determined and <br />declared to be reasonable and safe; and such speed limits are hereby fixed at the rate of <br />speed indicated for vehicles traveling upon State Highway 146 Main Line and State <br />Highway 146 Frontage Roads, or parts thereof, as more particularly described below: <br /> <br />NOW, THEREFOR BE IT ORDAINED BY THE CITY COUNCIL OF THE <br />CITY OF LA PORTE: <br />
