Minutes of Regular Meeting, Public Hearing and Workshop Meeting held on November 10, Page 3 <br />2008 <br />SECTION 106-799 "CONSTRUCTION, MAINTENANCE OF ELECTRIC FENCES <br />PROHIBITED," AMENDING APPENDIX-C 'FEES", AND AMENDING APPENDIX-B <br />`FINES" OF THE LA PORTE CODE OF ORDINANCES IN ACCORDANCE THEREWITH, <br />BY ALLOWING ELECTRIC FENCES ON THE PREMISES OF SINGLE-FAMILY <br />DWELLINGS; PROVIDING A REPEALING CLAUSE; CONTAINING A SEVERABILITY <br />CLAUSE; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; PROVIDING <br />THAT ANY PERSON VIOLATING THE TERMS OF THIS ORDINANCE SHALL BE <br />DEEMED GUILTY OF A MISDEMEANOR AND UPON CONVICTION SHALL BE FINED <br />IN A SUM NOT TO EXCEED TWO THOUSAND DOLLARS; PROVIDING FOR THE <br />PUBLICATION OF THE CAPTION HEREOF; AND PROVIDING AN EFFECTIVE DATE <br />HEREOF. <br />Motion was made by Councilmember Mosteit to approve Ordinance 1501-1-6 as presented <br />by Mr. Tietiens. Councilmember Malone seconded the motion. Public Hearing - Council to consider recommendation of Planning and Zoning Commission <br />regarding Special Conditional Use Permit (SCUP) #SCU08-008 for approximately 1-acre <br />tract located at 2226 Sens Road to allow use of two rooms at existing structure for bed and <br />breakfast rental - (Ord. 1501-M6) <br />Open Public Hearing - Mayor Porter opened the Public Hearing at 6:26 p.m. <br />Planning Director Tim Tietjens provided summary and recommendation and answered <br />Councils' questions. <br />Public comments: <br />Dean Wyman spoke in favor of the project. <br />Mayor Porter closed the Public hearing at 6:31 p.m. <br />Recommendation of the Planning and Zoning Commission — recommended to Council to <br />approve Ordinance 1501-M6, by granting Special Conditional Use Permit #CSU08-008 for <br />approximately 1-acre tract located at 2226 Sens Road to allow use of two rooms at <br />existing structure for bed and breakfast rental. <br />10.
