<br />Minutes of Regular Meeting, Public Hearing and Workshop Meeting of La Porte City Council on August 23,2010 <br /> <br />3 <br /> <br />Councilmember Moser recused himself from item E and informed the Council he had <br />signed a conflict of interest form with the City Secretary's Office. <br /> <br />Council noted they would like to see item H move forward. <br /> <br />Assistant City Attorney Clark Askins read the following resolution and ordinance captions: <br /> <br />Ordinance 3267- AN ORDINANCE APPROVING AN AMENDMENT TO THE BUDGET <br />FOR THE CITY OF LA PORTE; TEXAS, FOR THE PERIOD OF OCTOBER 1, 2009 <br />THROUGH SEPTEMBER 30, 2010; FINDING THAT ALL THINGS REQUISITE AND <br />NECESSARY HAVE BEEN DONE IN PREPARATION AND PRESENTMENT OF SAID <br />BUDGET; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW, AND <br />PROVIDING AN EFFECTIVE DATE HEREOF. <br /> <br />Resolution 2010-19 - A RESOLUTION AFFIRMING THAT THE CITY OF LA PORTE WILL <br />NOT USE EXCESSIVE FORCE DURING ANY NON-VIOLENT CIVIL RIGHTS <br />DEMONSTRATION ASSOCIATED WITH ANY PROJECT FUNDED BY THE TEXAS <br />COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM DISASTER RECOVERY <br />CONTRACT DRS010231, INCLUDING PHYSICALLY BARRING ENTRANCE TO A <br />FACILITY OF LOCATION WHICH IS THE SUBJECT OF SUCH DEMONSTRATION, AS <br />FOLLOWS: <br /> <br />Motion was made by Councilmember Black to table item E. Second by Councilmember <br />Zemanek. Motion carried unanimously. <br />Ayes: Engelken, Black, Rigby, Clausen, Zemanek, Mosteit and Mayor Pro-Tem Leonard. <br />Nays: None <br />Abstain: Moser <br />Absent: None <br /> <br />Motion was made by Councilmember Clausen to accept item K as presented. Second by <br />Councilmember Mosteit. Motion failed <br />Ayes: Mosteit, Clausen and Engelken <br />Nays: Rigby, Moser, Black, Leonard and Zemanek <br />Abstain: None <br />Absent: None <br /> <br />Motion was made by Councilmember Enqelken to approve the remainder of the consent <br />aqenda as presented. Second by Councilmember Moser.
