no future SCUP's required for individual development; and if a site development plan was <br /> presented on a piece of property above 10 acres in size, it would require review by the Planning <br /> and Zoning Commission but not come before City Council. <br /> Councilmember Earp questioned if this is the same location near Wharton Weems where the owner <br /> would need to have a truck lane to exit. Mr. Ensey responded he has no recollection of a truck lane <br /> exit being required and advised the loading docks will be on the west side of Hwy 146. <br /> James B. Harris, attorney representing Port Crossing Land, LP spoke and advised Council <br /> conditions were made to satisfy the SCUP as requested by the Planning and Zoning Commission <br /> before a building permit would be issued and a truck stop should not be on the location. <br /> City Planner Eric Ensey advised if there are any deviations from the terms of the SCUP, it would <br /> have to go back to the Planning and Zoning Commission and City Council. <br /> There being no public comments, the public hearing closed at 7:31 p.m. <br /> Councilmember Martin moved to approval a Special Conditional Use Permit (SCUP) for purpose of <br /> establishing use and development requirements for Port Cross Business Park, located north and <br /> west of State Highway 146 and Wharton Weems including all property included in the Final Plat of <br /> Port Crossing and Reserve A, Block 1, Port Crossing Section 1; and Reserve A, Boncosky Trucking <br /> Terminal, and an Ordinance amending Chapter 106, "Zoning, "of the Code of Ordinances by <br /> approving SCUP# 15-91000004. Councilmember Earp seconded. MOTION PASSED. <br /> Ayes: Mayor Rigby, Councilmembers Martin, Clausen, Kaminski, <br /> Earp and Engelken <br /> Nays: - None <br /> Absent: Councilmembers Zemanek and Leonard <br /> Prior to council action, Assistant City Attorney Clark Askins read the caption of Ordinance 2015-3597: AN <br /> ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF LA PORTE, CHAPTER 106, <br /> MORE COMMONLY REFERRED TO AS THE ZONING ORDINANCE OF THE CITY OF LA PORTE, BY <br /> GRANTING SPECIAL CONDITIONAL USE PERMIT NO. 15-91000004 FOR THAT CERTAIN PARCEL OF <br /> LAND HEREIN DESCRIBED, FOR THE PURPOSE OF ESTABLISHING USE AND DEVELOPMENT <br /> REQUIREMENTS FOR BUSINESS PARK, FOR MAKING CERTAIN FINDINGS OF FACT RELATED TO <br /> THE SUBJECT; CONTAINING A SEVERABILITY CLAUSE; FINDING COMPLIANCE WITH THE OPEN <br /> MEETINS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. <br /> 8. AUTHORIZATIONS <br /> (a) Consider approval or other action regarding recommendation by Planning and Zoning <br /> Commission to approve the Amended Development Agreement for the Port Crossing Business <br /> Park— E. Ensey <br /> City Planner Eric Ensey presented a summary. <br /> Councilmember Clausen moved to approve the Amended Development Agreement for the Port <br /> Crossing Business Park. Councilmember Engelken seconded.
