• <br />CITY OF LA PORTE <br />INTER-OFFICE MEMORANDUM <br />TO: KNOX ASKINS, CITY ATTORNEY DATE: <br />FROM: PLANNING & ZONING COMMISSIOPd, <br />PAT MUSTON, CHAIRP~IAN <br />SUBJECT <br />INTERPRETATION OF ZOPJING ORDINANCE <br />CONCERNING PARKING SPACES FOR OFFICE <br />BUILDINGS: 13-404 (6) AND 14-102 (1). <br />DECEMBER 19, 1979 <br />Planning & Zoning Commission met December 18, 1979, with <br />Mr. Jesse A4ireles (business card attached) who represented <br />World [aide Diesel, Inc. The purpose of the meeting was to <br />consider a request for a variance to permit fewer parking spaces <br />for a new office building. The ordinance requires five spaces <br />per 1000 sq. ft., and they requested that they be allowed to <br />have only three per 1000 sq. ft. The. request was denied. <br />During the discussion, the term "floor area", as defined in the <br />ordinance, was questioned. In 13-404 (6), the ordinance requires <br />1 space for each 200 sq. ft. of "floor area". In 14-102 (1), <br />"floor area" is defined as the gross floor area of the specific <br />use. The question: Is "specific use" to be interpreted as office <br />space, since this is to be an office building, or must it include <br />all supportive areas such as halls, stairways, rest rooms', etc.? <br />The interpretation will mean a difference of perhaps five spaces. <br />Mr. Mireles and World Wide Diesel, Inc.; are anxious to complete <br />their plans and begin construction very soon. They are also <br />anxious to comply with all regulations of the City of La Porte, yet <br />do not wish to purchase more land than will be required to meet <br />those regulations. <br />The Planning & Zoning Commission requests your interpretation of this <br />section of the ordinance. ~^7e will appreciate your guidance in this <br />matter. <br />Respectfully, <br />Pat Muston ~`G <br />
