r <br />June 3, 1980 <br />• T0: Mayor and City Commissioners <br />FROM: Planning & Zoning Commission <br />r: <br />SUBJECT: Request for variance at 5213 Crestway, Lot 5, Block <br />?, Glen Meadows, Section 1. bir. L.D. Tucker. <br />Mr. Tucker received a notice of violation from the Inspection <br />Department of the City of La Porte regarding a front yard fence. <br />Section 13-205 (3) of the zoning ordinance prohibits front yard <br />fences. <br />Mr. Tucker has a decorative split-rail fence across the front <br />of his property, to be used with shrubbery in his landscaping <br />plan. The fence is open at the sidewalk and driveway and is <br />approximately two feet high. It does not extend along the side <br />property lines. <br />The zoning ordinance does not define the term "fence". The de- <br />finition found in serveral dictionaries refers to a barrier form- <br />ing an enclosure. <br />Since Mr. Tucker's fence does not form an enclosure of any kind, <br />and since the low and open nature of the structure does not pre- <br />• sent a barrier for access of fire equipment, Planning and Zoning <br />Commission does not consider it a violation of the ordinance. <br />We feel that no variance is required. <br />We recommend that Mr. Tucker be allowed to keep his front yard <br />"fence" . <br />Respectfully, <br />Pat Muston, Chairman <br />• <br />
