~ ~ <br />April 29, 1985 <br />MEMO T0: <br />FROM <br />SUBJECT: <br />Site <br />Planning and Zoning Commission <br />~ - <br />Bob Speake, City Engineer, <br />Rezoning request, Lots 17-32, <br />GENERAL <br />Block 149, La Porte Town <br />The Fraternal Order of the Eagles, Bayshore Aerie Number 2753 has <br />asked that its property referenced above be rezoned from its <br />current "R-1" zoning to "C" Commercial. The applicant intends to <br />construct~a shell parking lot to provide supplementary off-street <br />parking for its new lodge building to be constructed on the west <br />half of Block 149. <br />The property under consideration for rezoning faces 7th Street <br />between G and H Streets. It borders the "C" commercial zone in <br />which the lodge building is to be constructed. The south half of <br />the property contains the small City park where "The Walk" is <br />located. (See Location Map, attached) <br />The City Police Administration complex is located south of this <br />property. To the east and north are single-family homes. To the <br />west are a mixture of single-family homes and small commercial <br />• establishments. (See Key Map, attached). <br />ANALYSIS <br />Th-e property lies within an "R-1" residential zone in which there <br />are no non-conforming uses. The consultants were aware of the <br />purity of this zone and recommended that it remain "R-1" in the <br />comprehensive plan. If this commercial rezoning were to be <br />approved, it could establish a precedent for further <br />non-conforming encroachment into a zone which is entirely <br />residential in character. It should be noted that the applicant <br />has satisfied City off-street parking requirements within the <br />boundaries of his commercially-zoned property. <br />STAFF RECOMMENDATION <br />Having a fraternal lodge located just next to a quiet residential <br />neighborhood is probably incompatible, but it does conform to <br />current zoning and has the legal right to be there. Adding their <br />parking lot next door does not make matters worse, except for the <br />dust raised from a gravel parking lot. Nonetheless, because this <br />request conflicts with the comprehensive plan and because allowing <br />this rezoning now may establish a bad precedent for the future, <br />staff recommends this request be denied. <br />• ENCLOSURES <br />as <br />
