«• <br />• <br />• <br />,' • • <br />CITY OF LA PORTE <br />INTER-OFFICE MEMO <br />T0: Plan g and Zoning Commission <br />FROM: D ~ ulissen <br />DATE: 02/12/86 <br />SUBJECT: Rezoning B1k. 2, Lts.22-24 Spenwick Place, Section 1 <br />The City has received a request from Mrs. Vivian Covington to rezone <br />Blk. 2, Lots 22 thru 24,•Spenwick Place, Section 1 from its temporary <br />"R-1" Residential classification to "C" Commercial. The reason for <br />the request is to allow the business to operate in a more efficient <br />manner. As the business. has a legally established pre-existing use no <br />rezoning is recommended until the entire area has been rezoned. <br />HISTORY <br />The property is located on the South side of West Main between <br />Hillsdale and Ridgefield in the Spenwick area. A used car lot and <br />grocery store is located and operating on the site. This property is <br />in the most recently annexed area of La Porte and has not yet received <br />its final zoning classification. The Comprehensive Plan indicates <br />that this area should remain "R-1". This issue has received much <br />study by the Commission and past policy indicate that rezoning should <br />not take place on any tracts not prevented from developing by zoning. <br />ANALYSIS <br />The entire Main St. frontage in this area has been discussed at length <br />by the Commission within the past year. The area in question has <br />received attention due to disagreements with the proposed zoning. <br />The result of the discussions was a policy of only rezoning in the <br />area if a use is proposed that fit. the character of the area and <br />zoning would prevent such development. 'f he present use is a legally <br />established pre-existing use under the current Ordinance and as such <br />• may remain in operation and expand on the same lot without zoning <br />conflicts. <br />RECOMMENDATION <br />It is not clearly underst <br />operated as a result of a <br />obstacle is seen staff <br />Commission, to table this <br />and finally rezoned ~,t <br />Porte. <br />god how the business wi_l7. be more efficiently <br />rezoning.
