<br />.- '" <br /> <br />CITY OF LA PORTE <br />INTER-OFFICE MEMO <br /> <br />TO: <br />FROM: <br /> <br />L~ Planning <br />~ulissen, <br />9/18/86 <br /> <br />and Zoning Commission <br /> <br />CBO/Zoning Administrator <br /> <br />DATE: <br /> <br />SUBJECT: RE-ZONING: 12.203 acre tract Richard Pearsall 1/3 Leage, <br />Abstract 625, along Fairmont Pkwy. <br /> <br />The Ci ty has received an application from Mr. Fred Westergren to <br />re-zone the above describe property from i~s temporary "R-1" <br />Residential classification to an "I" Industrial classification to <br />allow a medical waste incineration business. The property is located <br />between Pipe and Valve Inc. and BFI Industries on Fairmont Parkway. <br /> <br />HISTORY <br /> <br />The property under consideration is undeveloped and is the last vacant <br />tract between the Southern Pacific Railroad track and the commercial <br />reserves in Fairmont Park East. Section 13-505-(1) of the present <br />Zoning Ordinance requires "I" Industrial zoning and a special use <br />permit for all refuse disposal sites. <br /> <br />ANALYSIS <br /> <br />The site faces Fairmont Parkway and currently is served with sanitary <br />sewer and will be served by water in the near future. The facility <br />will incinerate medical waste through a high temperature burning <br />procedure that reaches 2000 degrees F in the final process. Winfield, <br />the proposed owner, will provide copies of all Federal, State, and <br />Local permits to the Planning and Zoning Board of Adjustments at the <br />time of application for their special use permit. <br /> <br />The re-zoning to Industrial would be consistent with the proposed new <br />zon ing and map. The proposed map sh-ows the property to be "BI" or <br />Business Industrial Park at this time. The proposed use is consistent <br />wi th other uses adj acent to it i ncl ud i ng BFI Industries, a waste <br />disposal company. <br /> <br />RECOMMENDATION <br /> <br />The staff has reviewed this request with respect to the proposed <br />master plan and find it to be substantially in conformance with it. <br />The site is surrounded by both light and business industrial uses and <br />fronts on a truck route. The re-zoning in and of itself will not have <br />a negative effect on the area. Any Industrial use must have a special <br />use permit from the P & Z Board of Adjustments so individual uses will <br />still be reviewed based on their merits. <br /> <br />Based on the above review, staff would recommend that the above <br />described property be re-zoned to an "I" Industrial classification. <br />
