Page 17 - Article X General Provisions <br />Add: Section 3 Limitations of Liability for use of Easements and Common <br />• Properties <br />Notwithstanding any other provision herein to the contrary, neither <br />Declarant, nor any utility company, nor the City of La Porte using any <br />utility easements shown on the Subdivision Plat, or any Common <br />Properties shown on the Subdivision Plat, or that may otherwise be <br />granted or conveyed covering the Common Properties, Common <br />Facilities, or the lots (as the case may be), or any portion thereof, <br />shall be liable for any damages done by them or their assigns, <br />agents, employees, or servants to fences, shrubbery, trees, flowers, <br />the street, storm sewer systems, private drives, or any other <br />improvement on property of the Declarant, Association, or Owner <br />situated on the land covered by any such easements or rights-of- <br />way. <br />Note: The remaining numbers will then need re-numbering. <br /> <br /> <br />
