The property in question is located at <br />the southeastern corner of the McCabe Rd./Hwy. 146 <br />intersection (see Exhibit A). <br />Current Zoning: PUD (Planned Unit Development [Exhibit B]) <br />Requested Zoning: 94.4768 acres to R-1, Low Density Residential <br />12.8792 acres to GC (General Commercial) <br />Requested Bv: Bayou Forest Property Ltd., property owner <br />• Background: The tract in question is a portion of the area that formerly <br />comprised the Bayshore Municipal Utility District (Bay MUD). <br />This area was annexed into the City of La Porte on December <br />31, 1988 (Ordinance 1626). Following annexation, the Planning <br />and Zoning Commission began a planning study of the former <br />Bay MUD area. This study resulted in an integration of the <br />former district into the City's Comprehensive Plan. Based on <br />the Comprehensive Plan determinations, permanent zoning <br />designations were assigned to the entire annexed area. This <br />was done by passage of Ordinance 1501-J (adopted June 12, <br />1989). <br />The PUD zoning designation was assigned to the tract in <br />question with the passage of this ordinance. The land use <br />designation underlying the PUD zoning was established as Low <br />Density Residential with a Commercial use node located in the <br />vicinity of the McCabe Rd./State Highway 146 intersection (see <br />Exhibit C). It is important here to note that the Land Use Plan <br />from which Exhibit C is excerpted, does not establish hard <br />boundaries. It rather illustrates patterns of development <br />envisioned by the Comprehensive Plan. <br />• <br />
