• • <br />Rezoning Request #R93-002 <br />• Jan Stevenson/&10-93 <br />Page 4 of 5 <br />only appropriate for the Bay Oaks Subdivision, it also serves to <br />conserve and enhance property values in both the Bayside <br />Terrace Subdivision to the north and the residential <br />communities to the south in the City of Shoreacres. <br />There has been, since the time of Plan implementation, no <br />change to the tract in question or the surrounding area that <br />warrants either a rezoning or an amendment to the <br />Comprehensive Plan. The applicant has not demonstrated that <br />a need for additional manufactured housing parks has arisen <br />since the time of Plan adoption. Even if a need were shown, <br />the applicant has not justified this location, in an existing <br />residential neighborhood, as opposed to a less intrusive location <br />in an otherwise undeveloped area. <br />In fact, rather than changes that would warrant a rezoning, <br />development activity since annexation would appear to affirm <br />• the intent and recommendations of the Comprehensive Plan. <br />The majority of the Bay Oaks Subdivision is developed. <br />Although there are a number of mobile and manufactured <br />homes in the subdivision, the majority of the homes are <br />conventionally built single family homes. <br />Since implementation of the plan, one new single home has <br />been built. Another existing home has been moved into the <br />subdivision and completely renovated. A new bayfront home is <br />scheduled for construction in the fall. This construction activity <br />would appear to affirm the Plan's intent that this area in <br />general, and Bay Oaks in particular be preserved as a <br />neighborhood for single family homes as the means to achieve <br />the highest and best use of property in this part of the City. As <br />there has been no change in the condition and circumstances <br />surrounding this area that justify a rezoning, the R-1 <br />designation is still the most appropriate zoning for the tract in <br />question. <br />• <br />
