CONSIDER GRANTING A REPEAT OF LOT 13; BLOCK 22; BAYSIDE TERRACE <br />AND LOT 9; BLOCK 13; BAY OAKS. THIS ITEM WAS TABLED FOLLOWING <br />PUBLIC HEARING CONSIDERATION AT THE JUNE 17,1993 PL,~-NNING AND <br />ZONING COMMISSION PUBLIC HEARING AND REGULAR MEETING. <br />Mr. Harrington stated that this item was originally addressed during the June 17, <br />1993, public hearing and regular meeting. Some concerns were expressed by several <br />citizens prompting a motion by the Commission to table the item until the next <br />meeting. <br /> <br />Following is staffs analysis of several areas of citizen concern: <br />Lot 9 in Bay Oaks, as it is presently configured, under City ordinance can be <br />developed as a residential homesite. Granting the requested replat will increase the <br />lot's bay frontage. Approval or denial of the replat will in no way impact the owner's <br />right or ability to build on this lot. <br />The property to be added to Lot 9 will be taken from the adjacent Bayside <br />Terrace lot (Lot 13, Block 22) as noted in staffs previous report. All property <br />will still conform with applicable City ordinances and appropriate Deed <br />Restrictions. <br />A concern was expressed that approving the replat would block access to or <br />in some way be detrimental to the Bay Oaks neighborhood pazk. The <br />property to be added to Lot 9 is at the point of closest proximity, <br />approximately 40 feet from the park. <br />• <br />Both the survey submitted by Mr. Valentin and the original Bay Oaks <br />subdivision plat (filed in May 1929) indicate that Lot 9 has direct frontage on <br />the Dwire Street right-of--way (see Exhibits A & B). The requested replat, if <br />approved, will not alter or affect the common property line between Lot 9 and <br />the neighborhood park, nor will it affect the existing access from Dwire Street. <br />
