• • <br /> <br />Page 2 of 7 <br />Planning & Zoning Commission <br />Minutes of July 21, 1994 <br />Mr. Harrington stated the second item deals with setback requirements for "Old La <br />Porte" lots, also requested by Chairman Bernay. The Boazd of Adjustment recently <br />heard a request for a variance that dealt with building and driveway setback from <br />side property lines. The applicant charged that a fifty foot wide lot was limiting in <br />terms of development options and was looking for some relief from the setback <br />requirements. Mr. Harrington stated that staff contends the problem is not <br />widespread enough toconsider ordinance amendment. Requests for variance setback <br />are heazd on a case by case basis, in a public hearing format. Since written notice <br />is sent to surrounding property owners, the people who aze impacted the most by a <br />change of setback have the opportunity to provide input during the decision making <br />process. <br />Mr. Hamngton added the third item was to update ordinance references that pertain <br />to the State's Manufactured Housing Act. The amendments will have no impact on <br />ordinance regulations. The proposed amended language is shown in bold: <br />• <br />• <br />Section 3-100. Definitions <br />Existin <br />Proposed <br />Modular Building: A building built to <br />specifications of the Texas Manufactured <br />Housing Standards Act, and the Texas <br />Department of Labor and Standards <br />(T.D.L.S.) Rules and Regulations designed <br />to be placed on a.permanent foundation <br />system consistent with the above <br />requirements. Said modulaz home or <br />modular building must beaz a T.D.L.S. <br />decal permanently affixed to each <br />transportable section or modular building <br />to indicate compliance with the State <br />standards. A modular home is not a <br />mobile home as defined herein. <br />Industrial Housing & Buildings: A <br />residential or commercial structure that is <br />constructed in one or more modules or <br />constructed using one or more modular <br />components, built to the specifications of <br />the Texas ,Department of Licensing and <br />Regulation (T.D.L.R.) Rules and <br />Regulations and designed to be placed on <br />a permanent foundation system consistent <br />with the above requirements. Said <br />industrialized house or building must bear <br />a T.D.L.R. approved decal or insignia <br />permanently affixed to each transportable <br />section or component of each <br />industrialized house or building to <br />indicate compliance with the State <br />standards. An industrialized house or <br />building is not a mobile or manufactured <br />home as defined herein. <br />
