• <br />CJ <br />• by the Commission, together with approval of Public Improvement <br />Construction Documents by the Director shall result in issuance of <br />a Development Authorization by the Department which permits the <br />developer to begin construction of subdivision improvements. Not <br />applicable in this case because it does not involve construction at <br />this time. <br />2. Disapproval of a Replat requires filing of a new Replat. , <br />Based on the factors involved in this request, it is clear that this Replat document should not yet <br />be approved. The City, however, has no objection to approving the replat once closure and <br />easement issues have been resolved. <br />The terms of the Development Ordinance do not provide a great deal of latitude for conditional <br />approvals. Outright disapproval, however, would require that the entire public hearing process <br />be repeated with a new submittal. Staff would therefore, recommend the following: <br />• Open the public hearing for the purpose of taking public comment. <br />• Following any comment, suspend the hearing to be reopened once the alley <br />closure has been completed and appropriate easement dedication language is <br />added to the Replat document. <br />As noted, the District's current Administration Building expansion can be carried out without <br />the Replat. Deferring action on this item will, therefore, will not impede progress on the <br />project. <br />• <br />
