OPPONENTS <br />Bruce Coplen, who resides at 14814 Larana Drive, Houston, Texas, and <br />whose professional address is 5847 San Felipe, Ste. 2440, Houston, <br />Texas, spoke as a representative from the law firm of Leger &Coplen. <br />Mr. Coplen was asked by several of his clients in the La Porte area to <br />address concerns they have regarding the ordinance. The areas of concern <br />are: <br />1. Page 4, Definition of Adult Cabaret, Subsection (B) <br />Definition is too broad and generalizing. The concern is from an <br />enforcement perspective. Performances such as lingerie shows, <br />bikini contests, etc. could be subject to abuse by enforcement <br />personnel. Definition targets a specific group, while excluding <br />similar activities that occur at the neighborhood pools and/or <br />public beaches. <br />2. Page 5, Definition of Nudity or a State of Nudity, Subsection (B) <br />Definition is vague and subjects enforcement personnel to <br />determine what "opaquely cover" means. <br />3. Page 6, Definition of Semi-Nude <br />Definition is vague and should be more specific. <br />4. Page 7, Section 5, Location of Adult Oriented Businesses <br />1. Fails to provide grandfathering for existing businesses. <br />2. Fails to provide grandfathering for existing adult oriented <br />businesses in the event that a new business would move in <br />and take priority over the existing business. <br />3. Definitions too broad. Possible abuse of situation from an <br />enforcement perspective. <br />V. CLOSE PUBLIC HEARING. <br />Chairman Waters closed the Public Hearing at 6:28 PM. <br />
