The Board of Adjustment,.' <br />shall hold 'a public.--hearing,' as required 'by Subsection (b)- <br />below, to 'establish 'an amortization period _or to consider <br />an application by the non-conforming, user for exemption <br />from thee... amortization and .termination requirements 'set :forth' <br />in this 4 - 205. If the Board of Adjustment grants an <br />exemption, the use shall be known as an "exempted non- <br />conforming use . If an'_'applcation for ,exemption <br />from amortization is -not submitted, :the Board of Adjustment <br />shall establish.' an `amortization period pursuant. to_ <br />Subsection (c) . <br />{'b) _ Public` Hearing.' <br />(I) The' Board of Adjustment 'shall hold a public hearing to <br />establish an'amortzation period'for'each`non-complying <br />use subject , to notification 'pursuant ;to 4 - 203 'or to <br />consider an application for an exemption from ,thee <br />amortization and '-termination `requirements of ths_ <br />Section pursuant to the. 'following notification <br />requirements: <br />(A),; Written notice. of the time and place of a...public <br />hearing, by certified mail, return. receipt <br />requested and postage prepaid, to the owner and' <br />occupant. of the non'.-.conforming use at least 30' <br />days prior to-the date of such_publc hearing; <br />(B)' Publication. at `least 3'0 :days prior- to the date of <br />public hearing of _ a notice of the _ time and place <br />of the hearing in at .least one' newspaper of <br />general'. circulation in the ..City;- and... <br />(C) Mailing of the: notice of publs hearing at leas <br />30> days prior to the date of the pul~lsc hearing to <br />property- owners within 2OO feet,, as determined <br />- 34 - <br />
