C~ <br />• <br />undertake a review of (i) any_`non-:conforming uses; or (ii) any <br />exempted non-conforming uses established pursuant to 4 - 204 or 4 - <br />205 and, 'after a,publc hearing and investigation as;,to the particular <br />use in:-question, .may require-.the revocation of. the use status and the <br />amortization ,or termination of such use. For purposes-of this;4 - 206; <br />a use described =in (i) or (ii) above:, shall be herein sometimes: <br />referred -.to as a '" Revocable ''Use .".," <br />a) Initiation of Revocation Procedure.- <br />The Board of Adjustment shall undertake "a .review of- ang- <br />Revocable use .only ...upon: (i) -its own -motion,' upon a <br />determination that a reasonable probability of, one' or=more' <br />grounds for termination 'under 4 ' - 2'06 (d) exist;:- (ii) a' <br />report from .the Plannng.Director recommending revocation of <br />the 'states of such Revocable 'Use, which shall be based upon` <br />a determination-..that a"..reasonable probabili y of one or ,more <br />grounds for 'termination -under 4 - 2.06(d)- exist for -ouch.' <br />recommendation; or (iii) valid petition of proper owners` <br />conforming .with .Subsection (b) below, provided after' due, <br />consideration of the petition,!. the Planning 'Director <br />pursuant to (ii},' recommends revocation 'to -.the Board of <br />Adjustment. In the event that the Planning Director, upon" <br />investigation., declines to recommend action by the'Board_of <br />Adjustment, the Planning Director' shall :inform the <br />petitioners -in writing of that decision. The Planning <br />Director's .decision !regarding the petition shall be- <br />appealable to the. Board of Adjustment under the procedures <br />contained in 11 -'604 of this Zoning Ordinance. <br />'(b) Petition of .Property Owners. <br />A petition may ,be submitted to `the Planning .Director-only' <br />with respect to a request for revocation of the status-of a' <br />Revocable Use, on a--form provided byor otherwise submitted <br />in a manner prescribed _,by the Planning Director. The <br />petition shall be filed with -the Planning 'Director and <br />signed by the owners of at least twenty percent (20%) of the <br />total .number of record owners as determined by the 'most <br />recently approved'_City tax roll, 'of land in the City, within <br />2.0.0 feet of the lot lines of the'Revocable Use, inclusive of <br />streets, alleys and rights-of-way. and shall set .forth the <br />grounds for the revocation. <br />(c) Board'Notice,`Revew and Decision. <br />Upon its own: motion, receipt of the Planning 'Director's` <br />report. recommending the xeuocation of 'the status of the <br />Revocable Use:- or a decision 'by the Board of Adjustment to <br />consider a revocation. requested in a petition of property!' <br />owners pursuant to 4 -,206(a}, the Board_of Adjustment shall' <br />hold..a_public hearing to consider ,revocation of a Revocable <br />- 36 - <br />
