Partners, Ltd, property owner <br />Reauested For: Block 1095; Parts of Lots 6, 7 and 27 and all of Lots 8 thru 26 and the <br />adjacent alley; Town of La Porte <br />Location: 1501 Fairmont Parkway <br />Present Zoning: General Commercial (G.C.) <br />Background: Block 1095 is part of the original plat of La Porte filed March 10, 1892, in <br />Volume 58, Pg. 461, of the Harris County Map Records. The applicant has <br />requested a Replat of the property in question for the purpose of <br />consolidating the alley and flanking lots into two lots that will be identified <br />as Lots 1 and 2. Lot 1 will be 0.5870 acres in size and Lot 2 will be 0.9798 <br />acres in size. See Exhibit A <br />Ordinance No. 96-2123 was approved by La Porte City council. This <br />ordinance vacated, abandoned and permanently closed the alley located in <br />Block 1095. No easement was retained. <br />Analysis: Under the terms of Section 4.07 of Development Ordinance1444, a replat of <br />all or a portion of a subdivision may be released for recordation and deemed <br />valid and controlling when the following conditions have been satisfied: <br />• The plat has been signed and acknowledged by only the owners of the <br />particular property which is being replatted or resubdivided. <br />This requvement has been satisf~d. <br />• The replat does not attempt to alter, amend, or remove any subdivision <br />covenants or restrictions. <br />• There is compliance with Sections 212.014 and 212.015 of the V.T.C.A <br />Local Government Codes. <br />.................... <br />_ ~,_ _ ,; <br />
