Staff' Report Replat for Hickham Industries August 21,1997 <br />Requested Bv: Eric Stivender, representative for Donald E. Babb, President, Hickham <br />Industries, Inc. <br />Requested For: A 29.0543 acre tract divided by a lot line, creating two tracts, located in Lot <br />9, F.A. Staashen Subdivision, Enoch Brinson Survey, A-5, Harris County, <br />Texas. <br />Location: 11518 Old La Porte Road <br />Present Zoning: Light Industrial (L.I.) <br />Background: The applicant, Eric Stivender, has requested a Replat of the property in <br />question for the purpose of consolidating tract one and tract two of Lot 9. <br />The applicant is simply requesting the removal of a lot line that divides the <br />property into two individual developable portions of property. The applicant <br />seeks to have the 29.0543 acres of property under one description. <br />Analysis: Under the teens of Section 4.07 of Development Ordinance1444, a replat of <br />all or a portion of a subdivision may be released for recordation and deemed <br />valid and co~olling when the following conditions have been satisfied: <br />• The plat has been signed and acknowledged by only the owners of the <br />particular property that is being replatted or resubdivided. <br />This requirement has been satisfied. <br />• The replat does not attempt to alter, amend, or remove any subdivision <br />covenanrts or restrictions. <br />No subdivision covenants or restrictions are in effect. <br />• There is compliance with Sections 212.014 and 212.015 of the V.T.C.A. <br />Local Government Codes. <br />These are the sections of State Law dealing with platting and <br />replatting. These provisions have been satisfied. <br />• The replat has been approved by the Commission after being prepared <br />and filed as though it were an original plat as specified in Section 4.04 of <br />the Development Ordinance. <br />Staff finds the replat document does comply with all applicable <br />ordinance requirements. <br />
