Staff' Report <br />Final Plat for FT & MC Subdivision <br />August 20,1998 <br />Reauested Bv: Mark Woods and Frank Fidelibus, property owners <br />Reauested For: Part of Commercial Reserve "E" "Not Part of Subdivision", Fairmont Park <br />East, Section I, Wm. M. Jones Survey, Abstract 481, La Porte, Harris <br />County, Texas. <br />Location: 10815 and 10817 Fairmont Parkway <br />Present Zoning: General Commercial (G.C.) <br />Background: This 0.8302 acre tract was filed with Fairmont Park East, Section I as <br />recorded in Volume 306, Page 69 of the Harris County Map Records. The <br />Planning and Zoning Commission considered this plat in their March 19, <br />1998 meeting. At that time, the Commission approved the plat with <br />conditions that should be met prior to formal recordation. <br />Since that meeting, the applicants have chosen to amend their original <br />request. The common azea has been deleted and the property is divided into <br />two equal lots. The lots will still be identified as Lots 1 and 2 of Block One <br />of the FT & MC Subdivision. <br />Analysis: Under the terms of Section 4.07 of Development Ordinance1444, a replat of <br />all or a portion of a subdivision may be released for recordation and deemed <br />valid and controlling when the following conditions have been satisfied: <br />• The plat has been signed and acknowledged by only the owners of the <br />particular property, which is being replatted or resubdivided. <br />This requirement has been. satisfied. <br />• The replat does not attempt to alter, amend, or remove any subdivision <br />covenants or restrictions. <br />No_subdivision cotenants or restrictions are in eff..ect. <br />• There is compliance with Sections 212.014 and 212.015 of the V.T.C.A. <br />Local Government Codes. <br />__ <br />These are the sections of State I,aw dealing yvith platting. ,;and <br />replattng.
