• • <br />Inter-Office Memorandum <br />To: Members of the La Porte Planning & Zoning Commission <br />From: Doug Kneupper, Director of Plannin <br />Subject: Minor Subdivision Piats <br />Date: October 9,1998 <br />C: <br />You are well aware of the number of minor subdivision plats that have been <br />presented to the Commission in recent months. Usually these plats contain one <br />or two lots that front on an existing roadway and utilities are already available. <br />State law allows for the delegation of approval responsibility to a City employee <br />for minor plats similar to the ones described above. The law states that the City <br />may delegate to an employee of the City the ability to approve: 1) amending <br />plats, and 2) minor plats involving four or fewer lots fronting on an existing <br />street and not requiring the creation of any new street or the extension of <br />municipal facilities. <br />However, the designated employee may, for any reason, elect to present the plat <br />to the Planning and Zoning Commission to approve the plat. In addition, the <br />designated employee shall not disapprove the plat and shall be required to refer <br />any plat, which he refuses to approve to the Planning and Zoning Commission <br />within the time period specified elsewhere in the statutes. <br />Staff feels this will be a beneficial tool for both the developers and City staff. <br />The developers will be required to prepare the exact same documents as before, <br />but scheduling to meet with the Commission may not be required. Staff will <br />continue to review all aspects of the plat but may not be required to prepare an <br />agenda and other material for presentation to the Commission. <br />At this time staff is requesting direction from the Commission to prepare the <br />necessary ordinance amendments for adoption by City Council. <br />
