Planning and Zoning Collission • <br />Minutes of March 18, 1999 <br />Page 2 of 3 <br />Seven notices of public hearing were mailed to surrounding property <br />owners. One response was received in opposition to the request. <br />A. PROPONENTS <br />Melvin Walker, 2126 Whatley, Deer Park, addressed the <br />Commission. Mr. Walker clarified several property <br />ownership questions for the Commission and expressed his <br />need for additional parking spaces for his restaurant. <br />B. OPPONENTS <br />There were none. <br />IV. CLOSE PUBLIC HEARING. <br />Chairperson Waters closed the Public Hearing at 6:15 PM. <br />V. CONSIDER RECOMMENDATION TO CITY COUNCIL FOR SPECIAL <br />CONDITIONAL USE PERMIT REQUEST #99-001. <br />A motion was made by Melton Wolters to recommend City Council <br />approval of Special Conditional Use Permit #99-001 with the following <br />conditions: <br />The off -site parking shall comply with all parking standards. <br />2. Screening and/or landscaping of parking lot shall be required. <br />3. The Lease Agreement, duly approved by the City Attorney, shall be <br />filed with the City Secretary. <br />4. A Certificate of Occupancy, renewable annually, shall be required. <br />5. The applicant is responsible for public hearing costs. <br />The motion was seconded by Sandie Staniszewski. All were in favor and <br />the motion passed. <br />VI. STAFF REPORTS <br />Mr. Kneupper presented an overview of a study and report on Bay Area <br />Blvd. that was submitted by the engineering firm of Binkley and Barfield. <br />
