Wilburn, Secretary <br />Requested For: A 10.1878 Acres of land being Outlot 697 and portion of Outlot 698 in the <br />W. B. Lawrence Subdivision, described in Volume 83, Page 344 of the <br />Harris County Deed Records, out of the William M. Jones Survey A482, <br />City of LaPorte, Harris County, Texas. <br />Present Zoning: Low Density Residential (R 1) <br />Requested Use: Residential Subdivision <br />Background: Summer Winds is a residential subdivision located on the north side of <br />Fairmont Parkway and west of Underwood Road (See Exhibit A). The <br />Amended General Plan for Summer Winds subdivision was approved by the <br />Commission on February 18, 1999 followed with the Preliminary Plat for <br />Summer Winds Section III, which was approved by the Commission during <br />their March 3,1999 meeting. <br />Anal sis: Star, using Development Ordinance Section 4.04 and Appendix D as a <br />guide, has reviewed Summer Winds Subdivision Section III Final Plat (See <br />Exhibit B) and found it to be substantial compliance with applicable <br />Ordinance requirements. The covenants for Section III have been reviewed <br />by the City Attorney's office and found to satisfy Ordinance requirements. <br />Utility construction plans have been reviewed and approved by Staff. <br />Section 5.02 of the Development Ordinance empowers the Commission to <br />require pedestrian sidewalks when it feels their inclusion will serve the <br />public interest. Staff would recommend the inclusion of sidewalks within the <br />subdivision. Responsibility for construction of the sidewalks should be <br />specified by covenant <br />Detention pond ownership and maintenance by the Homeowner's <br />Association shall be stated on the final plat. Language in the covenants and <br />on the face of the plat shall dedicate or transfer ownership of detention <br />reserve to the Homeowner's Association. <br />Summer Winds Section III consists of three blocks, 37 lots, and two <br />restricted reserves. The restricted reserve "A" approximately 0.5 acre is <br />reserved for detention pond and restricted reserve "B" approximately 0.1 <br />acre is designated for utility easements. About four dwelling units per acre <br />conform to the City's Comprehensive Plan. The proposed subdivision will <br />be located in Park Zone 1. The City's Development Ordinance prohibits the <br />dedication of parkland less than one acre in size; therefore, money in lieu of <br />parkland would be required. <br />
