0 <br />Hwy. 146 & 225, L.P. <br />7/15/99 P&Z Meeting <br />Page 2 of 2 <br />Conclusion: <br />• The gain, if any, to the public health, safety, and welfare of the City. <br />Based on the siting criteria noted above, the tract in question is suited for an <br />LI zone, which is a reasonable designation per aesthetic visual environment <br />of the City. The proposed zone change will not create a visually appealing <br />monument at the entrances and corridors of the City. <br />One of the principle goals and objectives of the Comprehensive Plan is to <br />develop entrance and scenic corridors, establish a first impression, enhance <br />the appearance of major thoroughfares, and create a recognizable identity for <br />LaPorte. The gateways establish a sense of arrival to an area, and create a <br />first impression and lasting identity. The zoning regulations and districts as <br />herein established have been made in accordance with a Comprehensive <br />Plan for the purpose of promoting health, safety, morals, and general welfare <br />of the City. <br />Under the circumstances, the question at issue is whether there have been <br />any changes in the area (development pressure, infrastructure changes, etc.) <br />that warrant a rezoning. There has been, since the time of plan <br />implementation, no change to the tract in question or the surrounding area <br />that warrants either a rezoning or an amendment to the Comprehensive Plan. <br />Furthermore, individual land development proposals should be considered <br />for approval at the scale of neighborhood, sub -area, and development project <br />planning, which are to be considered in subsequent zoning and rezoning <br />actions by the City. <br />• This request does not conform to the intent or recommendations <br />of the Comprehensive Plan. <br />• There have been no changes within the area in question that <br />warrant an amendment of the Comprehensive Plan. <br />• A change to the LI zone would be contrary to the goals and <br />objectives of the Comprehensive Plan. <br />Unless the applicant is able to demonstrate that the requested HI zone would be appropriate, the <br />Commission should not grant the zone change request. The zone change would be in contrast to the <br />Comprehensive Plan and contrary to the redevelopment strategy of the City. <br />Based on above listed consideration, Staff recommends denial of Zone Change Request #99-002. <br />
