Planning and Zoning Commission <br />Minutes of March 15, 2001 <br />Page 3 <br />B. DISCUSS REZONE #RO1-001 FOR APPROXIMATELY SEVEN ACRES OF <br />LAND THAT INCLUDES LOTS 69 & 70, PT. OF TRACT 71 LA PORTE <br />OUTLOTS, EAST OF THE PIPELINE CORRIDOR ALONG SPENCER <br />HIGHWAY. THE CITY IS SEEKING TO REZONE FROM <br />NEIGHBORHOOD COMMERCIAL (NC) TO HIGH DENSITY <br />RESIDENTIAL (R-3), BASED ON THE NEWLY ADOPTED <br />COMPREHENSIVE PLAN AND THOROUGHFARE PLAN. <br />Mr. Malik presented an overview of RO1-001, for the rezoning of <br />approximately seven acres on the north side of Spencer Highway <br />adjacent to Bayshore Baptist Church. The requested rezone from NC <br />(Neighborhood Commercial) to R•3 (High Density Residential) is based <br />on the recent adoption of the Comprehensive Plan and Thoroughfare <br />Plan, which does not contain a north/south arterial roadway in that <br />area. The previous plan included a road that would have been aligned <br />through a portion of Spencer Landing Subdivision. The 1984 Land Use <br />Plan provided for commercial uses in an area that would have been, a <br />major intersection and the NC zoning was established at the <br />intersection of the proposed roadway and Spencer Highway. Now, with <br />no -arterial roadway in the vicinity, commercial land uses and NC zoning <br />is no longer desirable: <br />Nine (9) notices of public hearing were mailed to property owners <br />surrounding the area in question. The City received one (1) response in <br />opposition. <br />1. PROPONENTS <br />There were no proponents. <br />2. OPPONENTS <br />Brad Dill, representative for.La Porte 33, LLC, addressed the <br />Commission. Prior to the meeting, Mr. Dill submitted a letter <br />stating his opposition to the rezoning. His company acquired <br />twenty (20) acres, which included one -acre along Spencer <br />Hwy. zoned neighborhood commercial. The one -acre is a <br />portion of the seven acres currently being considered for <br />rezoning. Mr. Dill noted that the value of the neighborhood <br />commercial zoning of the one -acre was a consideration at the <br />time they purchased the land. A land swap with Bayshore <br />Baptist Church has since occurred, with the exception'of the <br />one -acre along Spencer Hwy. zoned neighborhood . <br />commercial. Mr. Dill noted it would be detrimental to his <br />ownership -to have a zone change. from commercial to <br />residential for property located along a thoroughfare such as <br />Spencer Hwy. <br />
