Staff Report April 19, 2001 <br />Zone Change Request #01-002 <br />Requested by: <br />Requested for: <br />Location: <br />Present Zoning: <br />Eddie V. Gray, Trustee <br />Fairmont Park, JV. <br />TR 3A & 4A, Block 3, W. J. Payne Subdivision. <br />Spencer Highway <br />General Commercial (GC) <br />Requested Zoning: Low -Density Residential (R-1) <br />Background: The entire property the owner represents, which is located on the south side <br />of Spencer Highway, comprises 15.746 acres of land out of W. J. Payne <br />Subdivision, LaPorte, Harris County, Texas. This tract is bounded on the <br />east by a pipeline corridor, on the west by Rizzuto Elementaryand a school <br />access drive, on the south by existing single family residential, on the north <br />by Spencer Highway, and the Fairmont Park Baptist Church is in the vicinity <br />at the southwest corner of the subject property.. . <br />The applicant is seeking this rezoning from. General Commercial (GC) to <br />Low Density Residential (R-1) to provide for single-family dwellings. As <br />shown, this rezoning would consist of 14.2 acres while the remaining 1.5 <br />acres along Spencer Highway would remain zoned General Commercial. <br />Analysis: In considering this request, Staff has reviewed the following Comprehensive <br />Plan elements: Land Use, Thoroughfare System; Parks and Recreation, <br />Utility Infrastructure, and Residential Development. The specific issues <br />considered are as follows: <br />Land Use — Review of the City's adopted Land Use Plan indicates this area <br />is envisioned as developing with mid -to -high density residential with no <br />commercial uses in the subject tract. Development of the adjacent <br />properties is a mik of residential, commercial and educational. The <br />requested change would not be detrimental to the present uses of nearby <br />properties. <br />Transportation_ — The tract in question has approximately 1500 feet of <br />frontage along the south side of Spencer Highway. Spencer Highway, a <br />primary arterial with 1004 right-of-way, should easily accommodate the <br />traffic generated by this development. <br />
