Harris Survey, <br />La Porte Texas. <br />Applicant <br />Scott Rodriguez <br />Present Zoning <br />Planned Unit Development (PUM <br />Acreage <br />5.89 acres <br />Surrounding Zoning <br />North Planned Unit Development (PUD) <br />East Planned Unit Development (PUD) <br />South Low -Density Residential (R-1) <br />West Low -Density Residential -1 <br />Land Use <br />Residential <br />Activity Proposed <br />Single-family dwelling w/ Accessory building <br />Summary: • <br />The applicant is requesting a Special Conditional Use Permit (SCUP) for <br />developing a single-family dwelling with a 60'x100'(6,000 square feet) of <br />accessory structure (detached garage). <br />• <br />Accessory buildings in single-family residential large lots may not exceed 2,000 <br />square feet of floor area per Section 106-741(e)(2) of the Ordinances. <br />• <br />Furthermore, accessory building with a floor area in excess of 1,000 square feet <br />must be located at least thirty -feet (30') from any property line and thirty -feet <br />(30') behind the rear of the primary structure <br />• <br />Earlier, the City's Zoning Board of Adjustment in their December 4, 2003, <br />meeting, granted variance for the proposed development. <br />• <br />The development in PUD district is subject to a Special Conditional Use <br />Permit (SCUP). <br />• <br />The subject property is surrounded by residential uses or developments in all <br />directions. <br />• <br />The area is earmarked for residential uses in the La Porte Comprehensive <br />Plan. <br />• <br />The overall impact on public services should be minimal. <br />• <br />Streets/roads should have adequate capacity to handle the traffic generated <br />by this proposed development. <br />• <br />The impact upon the public health, safety, and welfare of the city should be <br />minimal. <br />Recommendation: Staff recommends approval of SCUP with the following conditions: <br />• Accessory building must be located at the minimum of thirty -feet (30') behind <br />the rear of the primary structure, as required by the City's Code of Ordinances. <br />The building must be set back at least 100 feet from the rear and side property <br />lines. <br />• Assure that the proposed structure is not visible from the neighboring <br />residential properties to the south. <br />• Ensure that tree line will be preserved for at least 100' from the side and 150' <br />from the rear property line as shown on the site plan. <br />• The roofed -over structures on the property do not accumulatively exceed the <br />maximum forty percent (40%) lot coverage. <br />• Additional development at site shall be subject to a new application for a <br />Special Conditional Use Permit. <br />Action Required by the • Recommend to Council approval of this SCUP with conditions. <br />Commission: 0 Recommend to Council denial of this SCUP. <br />
