The Commission felt <br />the item should be tabled until such time the applicant could return with a definite plan <br />for development. <br />Motion by Paul Berner to table the request for Special Conditional Use Permit #SCU04- <br />008 for an additional development to an existing mini-storage/warehouse facility. <br />Second by Dorreta Finch. CONSIDER RECOMMENDATION TO - CITY <br />COUNCIL REGARDING SPECIAL CONDITIONAL .USE PERMIT #SCU04-009 FOR <br />THE PROPERTY LOCATED AT 2219 UNDERWOOD ROAD. THE APPLICANTS <br />SEEK APPROVAL OF A SPECIAL CONDITIONAL USE PERMIT FOR PROVIDING <br />OFF -SITE PARKING FOR A RESTAURANT. OFF -SITE PARKING IS DESCRIBED <br />AS A CONDITIONAL USE IN A GENERAL COMMERCIAL ZONE PER THE CITY'S <br />CODE OF ORDINANCES, <br />Mr. Malik presented staffs report: The applicant, Melvin Walker, has requested a <br />special conditional use permit to allow off -site parking for the Texas Grill restaurant <br />located at 2219 Underwood Rd. The applicant received permission from'the neighboring <br />property owner to utilize their parking with a six-month lease, while -pursing a land deal <br />for permanent parking. Staff recommended approval with conditions. <br />The applicant, Melvin Walker, 2126 Whatley Dr., Deer Park, addressed the Commission. <br />Mr. Walker expects to have a lease -purchase contract signed with Otis Wright within the <br />next week. He plans to install permanent parking and detention. <br />Seven public notices were mailed to nearby property owners. No responses were <br />received. <br />Motion by Doretta Finch to approve Special Conditional Use Permit #SCU04-009 for <br />offsite parking for a restaurant located at 2219 Underwood Road, with the following <br />conditions: <br />1. Special Conditional Use Permit for lease of off -site parking shall be limited to a <br />period of six. months. <br />2. The proposed permanent site for off -site parking shall -be in compliance with all <br />applicable City regulations, shall -require screening and/or landscaping of the <br />parking lot and shall be approved only after review of a certified site plan. <br />3. Lease agreement, duly approved by the City Attorney, shall be filed with the City <br />Secretary. <br />4. A certificate of occupancy, renewable annually, shall be required. <br />
