Planning and Zoning Commis3Ton • <br />Minutes of February 17, 2005 <br />Page 6 <br />Mr. Sabo responded to questions from the Commission. <br />Cheryl Hargett, of 3617 E. Desert Dr., commented there had been many animals on the <br />property and there was a foul odor. Ms. Hargett inquired when the owner started <br />clearing the land and was told it was none of her business. Ms. Hargett stated the trees <br />that were creating a buffer were removed. She noted drainage problems. The property <br />drains foul smelling stagnant water onto her property. She complained of stacks of <br />wood, standing water, and excess lighting. <br />J. B. Williamson noted that all excess animals have been removed. <br />Cliff Hagemeister, of 3613 E. Desert Dr., reported that excess lighting is a problem. He <br />does not have an issue with the animals. <br />Donald Davis, of 3621 E. Desert Dr., spoke again to confirm the comment by Mr. Davis <br />about the .drainage issue. He spoke of the problems the subdivision experiences during <br />rain events. Commercial businesses mean more concrete. <br />Russell Hargett, of 3617 E. Desert Dr. opposes future commercial development along <br />Underwood Rd. <br />During Commission discussion, it was pointed out that if rezoned, it could allow <br />Neighborhood Commercial development throughout the entire tract. <br />Chairperson Muston closed the public hearing at 7:50 p.m. <br />Motion by Nick Barrera to recommend to City Council, denial of #R05-002 to rezone <br />property located at 3900 Underwood Rd., from Low-Density Residential (R-1) and <br />Medium-Density Residential (R-2) to Neighborhood Commercial (NC). There was no <br />second. The motion failed. <br />Motion by Les Bird to recommend to City Council, approval of #R05-002 to rezone <br />property located at 3900 Underwood Rd. from Low-Density Residential (R-1) and <br />Medium-Density Residential (R-2) to Neighborhood Commercial (NC). Second by Dottie <br />Kaminski. The motion failed. <br />Ayes: Bird, Kaminski and Muston <br />Nays: Finch, Barrera, Bemer and Lawler <br />Abstain: None <br />Motion by Nick Barrera to recommend to City Council, denial of #R05-002 to rezone <br />property located at 3900 Underwood Rd. from Low-Density Residential (R-1) and <br />Medium-Density Residential (R-2) to Neighborhood Commercial (NC). Second by <br />Doretta Finch. The motion carried. <br />Ayes: Barrera, Finch, Berner and Lawler <br />Nays: Bird, Kaminski and Muston <br />Abstain: None <br />
