(Arete Real Estate and Development Co.) <br /> <br />20.119 acres of land located in the W. P. Harris Survey, A-30, La Porte, <br />Harris County, Texas. This property is further described as being located <br />between State Highway 146 and the Bay Forest Golf Course. <br /> <br />Planned Unit Development (PUD) <br /> <br />Low-Density Residential (R -1 ) <br /> <br />This property is located at the northeast comer of McCabe Road at State <br />Highwayl46. It is bounded on the east by the Bay Forest Golf Course. On <br />the north, it is adjacent to the Lakes at Fairmont Greens, Section 1, a <br />proposed single-family residential development on approximately 35 acres <br />surrounded by the Bay Forest Golf Course. <br /> <br />The Lakes at Fairmont Greens, Section 9, has an approved General Plan <br />and Special Conditional Use Permit #SCU07-004. The Preliminary Plat <br />for Section 9 was approved by the Commission at the May 22, 2007, <br />meeting. The plan has 108 units of single-family zero lot line with several <br />reserves. Lots have reduced building setbacks with 20' wide alley in the <br />rear for primary access. <br /> <br />The project is inconsistent with the Special Conditional Use Permit and <br />General Plan approved earlier for the Lakes at Fairmont Greens. In <br />addition, Developer's Agreement, Covenants, Conditions, and Restrictions <br />(CCRs) were not filed for review by the City. A 20' wide alley in the rear <br />for vehicular and primary access to the lots, maintenance (Public/private), <br />and alley design (one-way) were the other notable issues related with this <br />development. In addition, City Council added a provision that developer's <br />agreement and CCRs must be approved by Council prior to filing of the <br />final plat. <br /> <br />The developer has now submitted a request to withdraw Preliminary Plat for <br />Section 9 (copy attached).
