"DRAFT" <br />City of La Porte <br />Special Conditional Use Permit # SCU 09-001 <br />This permit is issued to: Lloyd and Linda Duncan <br />Owner or Agent <br />1822 Gaucho Circle, La Porte, TX 77571 <br />Address <br />For Development of: Underwood Self Storage (Expansion) <br />Development Name <br />2619 Underwood Road, La Porte <br />Address <br />Legal Description: SE Portion of Lot 10, Block 2 W. J. Payne Subdivision <br />La Porte, Harris County, Texas. <br />Zoning: General Commercial (GC) <br />Use: Self Storage & Mini -Warehousing <br />Permit Conditions: <br />1. SCUP#09-001 is specifically limited to the self storage (mini -warehousing) as defined in SIC #4225. <br />2. Development abutting "R-1" district shall be screened and landscaped with at least 10' wide planting <br />strip of heavy landscaping. This landscaping should be sight obstructing as follows: <br />a) Minimum height and distance for trees at the time of planting shall be 8', minimum caliper 4", <br />and 1 per 20' on center. <br />b) Shrubs shall be minimum of 5 gallons, 3' high and 1 per Ton center. <br />c) Irrigation/landscape meter is suggested for proper maintenance of the plantings. <br />3. All landscaping and screening shall be maintained by the owner/developer. <br />4. Current trees adjacent to the residential development and church are to be maintained. <br />5. Landscape plan shall be required for the new landscaping to be approved by the City. <br />6. Facility lighting shall be arranged as to reflect the light away from the adjacent residential properties in <br />compliance with Section 106-521(c), footnote A, Code of Ordinances. <br />7. All outside storage shall be screened from public view and neighboring residences. <br />8. Ensure that maximum roof coverage does not exceed 40% on entire 6.86 acre tract to be replatted. <br />9. Provide on -site detention for an additional development and design in such a way as not to inhibit <br />normal sheet flow of adjacent properties. <br />10. This permit does not become valid until a formal Development Site Plan and Replat are submitted to the <br />City; reviewed and approved in accordance with the requirements of the Development Ordinance. <br />11. The Developer shall comply with all applicable laws and ordinances of the City and the State of Texas. <br />Failure to begin construction within 12 months after issuance or as scheduled under the terms of a special <br />conditional use permit shall void the permit as approved, except upon an extension of time granted after <br />application to the Planning and Zoning Commission. <br />If construction is terminated after completion of any stage and there is ample evidence that further development is <br />not contemplated, the ordinance establishing such special conditional use permit may be rescinded by the City <br />Council, upon its own motion or upon the recommendation of the Planning and Zoning Commission of the City of La <br />Porte, and the previous zoning of the entire tract shall be in full effect on the portion which is undeveloped. <br />Validation Date. - <br />Director of Planning <br />City Secretary <br />EXHIBIT E <br />
