<br />Planning and Zoning Commission <br />Minutes of July 16, 2009 <br />Page 3 of 4 <br /> <br />A. Staff Presentation <br />Masood Malik, City Planner presented staff's report. <br /> <br />B. Proponents <br />Brook Wycoff, of 8915 Appomattox addressed the Commission. Mrs. Wycoff voiced her <br />concerns with the fence problems at her home. Since Hurricane Ike the fence at Pecan <br />Plantation has not been replaced. Mrs. Wycoffs home is adjacent to Discount Tire. Mrs. <br />Wycoff has been witness to a person from the parking lot of Discount Tire taking her bicycle <br />from her yard. Her neighbor witnessed the same with her child's bicycle 3 months ago. <br />Mrs. Wycoff expressed concern for her children's safety, and the nuisances of noise from <br />the parking lot and traffic from Canada Road. Mrs. Wycoff told Commission several <br />neighbors have requested management to replace the fence and offered to pay for their <br />own individual fencing, but was denied. <br /> <br />C. Close public hearing. <br />Chairman Hal Lawler closed the public hearing at 8:46 pm. <br /> <br />7. Consider recommendation to City Council regarding fence requirement, height, and <br />placement. <br />Motion by Les Bird for the following: <br />. Accept the amendment to manufactured housing fence requirements. <br />. Accept the 8ft height requirement for all residential housing. <br />. Remove the existing fencing for commercial and Industrial zoning district. <br />Second by Dottie Kaminski. The Motion carried. <br /> <br />Ayes: <br /> <br />Hal Lawler, Paul Berner, Dottie Kaminski, Les Bird, Richard Warren, Kirby <br />Linscomb Jr., and David Janda (Alt 1). <br />None <br />None <br /> <br />Nays: <br />Abstain: <br /> <br />Commission member Paul Berner requested a correction to Ordinance Sec. 106-792. <br />Commission members and staff agreed the word "not" should be removed from the third sentence <br />and should read as such; <br /> <br />Sec. 106-792. Large lot residential lots. <br />In case of large lot residential lots, eiaht feet perimeter fences are permitted as an accessory use. <br />In the case of lots with a front yard directly adjacent to the shoreline of Galveston Bay, four feet <br />front yard fences are permitted parallel and adjacent to the side lot lines. However, such fences <br />shall oot be permitted on the front lot line directly adjacent to Galveston Bay, and shall only be <br />constituted of chain link. These exceptions do not permit structures, grading, or barrier hedges. <br /> <br />8. Administrative Reports <br />Planning Director, Tim Tietjens gave administrative reports. <br />1. The original tanks that were underground at Town Plaza have been removed. The <br />grading is complete and the pillars are now in. <br />2. The Gateway project is ongoing; 70% drawings completed. <br />3. Council authorized the purchase of additional Holiday decorations for Main Street this <br />fall. <br />4. The Governor has signed a bill which when finalized would transfer maintenance <br />responsibility of Main Street to the City. <br />
