Call to Order. <br />Meeting called to order by Chairman Hal Lawler at 6:00 p.m. <br /> <br />2. Consider Approval of the July 16, 2009, regular meeting minutes. <br />Motion by Dottie Kaminski to approve the regular meeting minutes of July 16, 2009. Second by <br />Paul Berner. Open public hearing to receive citizen input on Special Conditional Use Permit #SCU09-003 for <br />property located at 803 McCabe Road, further described as 5.89 acres of land, TRS 5G & 5H, <br />W.P. Harris Survey, Abstract 30; La Porte, Harris County, Texas. Han van Esch, property owner, <br />seeks approval of a Special Conditional Use Permit to utilize an existing accessory building for <br />consulting inspection services within a Planned Unit Development (PUD) zone. <br />Chairman Hal Lawler opened the public hearing at 6:03 p.m. <br /> <br />A. Staff Presentation <br />Masood Malik, City Planner presented staffs report. <br /> <br />B. Proponents <br />Applicant Helmie van Esch, of 803 McCabe Road spoke in favor of SCU09-003. <br /> <br />C. Opponents <br />There were none. <br /> <br />D. Proponents Rebuttal <br />There were none. <br /> <br />4. Close public hearing. <br />Chairman Hal Lawler closed the public hearing at 6:12 pm. <br /> <br />5. Consider recommendation to City Council regarding Special Conditional Use Permit <br />#SCU09-003 for property located at 803 McCabe Road. <br />Motion by Kirby Linscomb to approve Special Conditional Use Permit #SCU09-003 with the <br />following conditions. <br />1. Retain 100' setback from the east, west and south property line adjacent to <br />residential for buffering purposes with all other setbacks as required. <br /> <br />2. There shall be no change in the outside appearance of the building or premises <br />and all performance has to be residential in nature. <br /> <br />3. No sign or display visible from the exterior of the dwelling shall be allowed. <br />
