Consider recommendation to City Council regarding Special Conditional Use Permit <br /> Request #11- 91000001. <br /> Motion by Richard Warren to approve recommendation to City Council for Special Conditional <br /> Use Permit Request #11- 91000001 for the property located at 401 North 2nd Street, with the <br /> following conditions: <br /> 1. This Special Conditional Use Permit is specifically for an off -site parking lot for DeWalt <br /> Alt. School. <br /> 2. Off -site parking shall comply with all parking standards. <br /> 3. Screening and /or landscaping of parking lot shall be required in accordance with <br /> Section 106- 444(a) of the Code of Ordinances. <br /> 4. All lighting in the parking lot shall be hooded and arranged to deflect light away from <br /> the adjoining residential properties in compliance with Section 106- 521(a) of the <br /> Code of Ordinances. <br /> 5. The Developer shall comply with all applicable laws and ordinances of the City and <br /> the State of Texas. <br /> 6. The developer will install a "No Parking" sign to prohibit after hours parking. <br /> Second by Dottie Kaminski. Motion carried. <br /> Ayes: Hal Lawler, Les Bird, Dottie Kaminski, Danny Earp, Kirby Linscomb Jr., Lou Ann <br /> Martin, Richard Warren, and David Janda. <br /> Nays: None <br /> Abstain: None <br /> Prior to discussion of item number 6., Chairman Lawler left the room and Vice Chairperson <br /> Dottie Kaminski chaired the meeting. <br /> 6. Open Public Hearing to receive citizen input on Special Conditional Use Permit Request <br /> #11- 91000002, for Port Modal Centre to be located at 1400 State Highway 146 North. The <br /> property is further described as 13.54 acres being TR 27 of Block 27, TR 28 of Block 28, <br /> Nebraska Syndicate and TR 3 in the Enoch Brinson Survey, Abstract 5, Volume 65, Page <br /> 175 of the H.C.D.R. La Porte, Harris County, Texas. Port Modal Centre, L.P., is seeking <br /> approval of a permit for proposed 300,000 sq. ft. of office /warehouse facility in a Planned <br /> Unit Development (PUD) zoning district. Under Section 106 -216 of the Code of Ordinances, <br /> a Special Conditional Use Permit is required for development in a PUD district. <br /> Vice Chairperson Kaminski opened the public hearing at 6:19 p.m. <br /> A. Staff Presentation <br /> Masood Malik, City Planner, gave staff's report. <br /> Six public hearing notices were mailed to property owners within 200' of the subject <br /> property; Staff received no response. <br /> B. Proponents <br /> There were none. <br /> C. Opponents <br /> There were none. <br /> D. Proponents Rebuttal <br /> There were none <br /> 7. Close Public Hearing. <br /> Vice Chairperson Kaminski closed the public hearing at 6:24 p.m. <br />
