Rodriguez. Mr. Rodriguez owns a piece of property at 518 <br />S. Third. At the time of purchase, there was a house and a garage on <br />the site. The garage contained a small bath and kichenette but was <br />not us~ as a living unit. Note that the garage doors were in place at <br />the time of purchase. <br />The request is not proper as it asks for approval of remodeling. The <br />Board of Adjustment does not approve building permits and can only <br />deal with an appeal from a decision of the Building Official. The <br />request should properly ask for the placement of a secondary dwelling <br />unit for rental purposes in an R-1 zone. <br />Before this sort of request can be effected the question off' lo-t---s-~,~e <br />must also be addressed. The current ordinance requires'6000 sq. ft:~~ <br />of lot area for a dwelling unit in an R-1 zone. Also r_gs~.t "-~~-s °t05fl' <br />sq. ft. of living area per dwelling unit. Nie ther of these <br />ements have been me M <br />The "continued use of this secondary dwelling unit" is not a proper <br />request as the building in question was clearly used as a garage until <br />converted by Mr. Rodriguez. Note that all of the problems and <br />questions now before us could have been easily avoided by making a <br />building permit application prior to construction. <br />This request is in clear conflict with the intent and letter of the <br />zoning ordinance and denial of the request is hereby recommended. <br />
