<br />I <br /> <br />Minutes, La Porte Zoning Board of Adjustment <br />August 23, 1984, Page 2 <br /> <br />David Paulissen explained that Mr. Rodriguez had begun <br />converting a two-car garage that had a kitchenette and <br />bathroom facilities from a previous owner. It was being used <br />as a garage when Mr. Rodriguez purchased the property. A <br />permit had not been obtained by Mr. Rodriguez for the work he <br />was doing, so the job had to be stopped. <br /> <br />The Zoning Ordinance provides for a secondary dwelling unit on <br />site in a residential zone if it is your homestead and if the <br />living quarters are for bona fide servants, family, guests, <br />etc., and specifically states it is not to be used for rental <br />purposes. <br /> <br />Mr. Paulissen understood that Mr. Rodriguez had bought the <br />property for the purpose of renting and had intended that the <br />garage be converted into a secondary dwelling unit and rented, <br />also. <br /> <br />Mr. Rodriguez hadd verbally inquired if a buillding permit <br />could be issued for this, and Mr. Paulissen had verbally told <br />him it could not. Subsequent to that, Mr. Rodriguez did apply <br />for a building permit and it was denied, as it did not meet <br />the requirements of the ordinance. <br /> <br />Mr. Rodriguez spoke to the Board and passed out photographs of <br />the subject property showing the existing kitchenette and <br />bathroom facilities that had electrical and plumbing already <br />in place when he purchased the property. Mr. Rodriguez stated <br />he is requesting a permit to complete the remodeling of the <br />secondary dwelling and if granted the permit, the secondary <br />dwelling would be in a condition that would enhance the area. <br />He stated that he had intended to rent both structures in <br />order to meet the note each month. <br /> <br />After questions from the Board, motion was made by Charli~ <br />Young to deny the request of Jack Rodriguez to appeal the <br />decision of the Building Inspector regarding section 1~-201-8 <br />of the Zoning Ordinance. Second by Lawrence Farias. The <br />motion to deny the appeal carried, 3 ayes and 1 nay. <br /> <br />Ayes: Lawrence Farias, Charlie Young, Andy Wilson <br />Nays: Linda Mains <br />
