<br />.. <br /> <br />CITY OF LA PORTE <br /> <br />INTER-OFFICE MEMORANDUM <br /> <br />DA T E: <br />TO: <br /> <br />July 31, 1986 <br /> <br />SUBJ ECT: <br /> <br />PI~g & Zoning Board of Adjustment <br /> <br />D~aulissen, Chief Building Official, Zoning Admin. <br /> <br />Request by Raymond and Linda Lott for special exception to <br />Zoning Ordinance for 8803 Gladwyne Ct. <br /> <br />FROM: <br /> <br />This request is for a special exception to the rear yard set back <br />requirements of section 13-204 (3) of City Ordinance # 780-RR. <br /> <br />A special exception may be granted under the following circumstances. <br /> <br />Section 16-201 of Ordinance # 780: <br /> <br />"The Board of Adjustment is hereby empowered to permit the <br />following exceptions... <br /> <br />(1) Permit such modifications of the height, vard only, <br />spacing and parking regulations as may be necessary to <br />secure appropriate development of a parcel of land of <br />such unusual topographv or restricted area and shape <br />that it cannot be appropriatelv developed without <br />modification." <br /> <br />BACKGROUND <br /> <br />Plans for this room addition were reviewed and the permit was approved <br />by the City on July 14, 1986. <br /> <br />The City's plan reviewer made a notation on the site plan (copy <br />enclosed) requiring the rear wall of the addition to be located 18 <br />feet from the rear property line. <br /> <br />This is in accordance with Section 13-204 (3) of City Zoning Ordinance <br /># 780-RR which reads: <br /> <br />"Rear Yard: The rear yard shall have a mInImum depth of 18 feet <br />or 10 feet from any utility easement, whichever is greater..." <br />
