<br />.. <br /> <br />CITY OF LA PORTE <br />INTER-OFFICE MEMORANDUM <br /> <br />DATE: August 18, 1986 <br /> <br />TO: Planning & Zoning Board of Adjustment <br /> <br />FROM: D~aulissen, Chief Building Official/Zoning Administrator <br /> <br />SUBJECT: Donna Cooper's request for a variance Section 13-205 (3) of <br />Ordinance # 780, to allow front yard fence. <br /> <br />Section 13-205 (3) of City Ordinance # 780 reads as follows: <br /> <br />Fences: Front yard fences will not be permi tted, side or back <br />yard fences will be permitted;... <br /> <br />Ms. Cooper is requesting two separate variances to this section of the <br />City's Zoning Ordinance. The first is to allow Lots 18-21 of Block 3; <br />Pinegrove Valley to be fenced to their front property lines. <br /> <br />Section 16-202 of Ordinance 780 reads as follows: <br /> <br />Granting of Variances: The Board of Adjustment is hereby <br />autho r i zed upon appeal from the dec i s ion of the admin istrat i ve <br />officer to grant in specific cases such variance from the terms of <br />this Ordinance as will not be contrary to public interest, where, <br />owing to special conditions, a literal enforcement of the <br />provisions of the Ordinance will result in unnecessary hardship, <br />and so that the spirit of this Ordinance shall be observed and <br />substantial justice done. <br /> <br />Staff requests the Board to refer to the City Attorney for the <br />definition of hardship under the State law. <br /> <br />Leaving this property unfenced will not cause a hardship as defined. <br />Staff therefore recommends against granting this variance. <br /> <br />Ms. Cooper's second request is to expand an existing front yard <br />fence. The present fence is located at the Cooper's residence at <br />11802 Plainbrook Road and encloses Lots 10-13 of Block 4. Ms. Cooper <br />is requesting a variance to allow the front yard fence to be expanded <br />to enclose Lot 9 as well. <br />
