The Chem Coast site, which had a <br />• commercial zoning designation at the time of construction, has since <br />been rezoned to R-1 Low Density Residential. This rezoning has made <br />Chem Coast a legally established non-conforming use. (See Exhibit A) <br />Part of the Chem Coast facility is comprised of a freestanding <br />concrete block building used for the storage of test samples. <br />Structural problems with this building have apparently rendered it <br />unusable. Chem Coast has indicated to Staff that repair is impossible <br />at this time due to a pending lawsuit regarding the building's apparent <br />failure. This has left Chem Coast without proper rneans to store test <br />samples. <br />Chem Coast is proposing to build a new, comparably sized storage <br />building (25'x60'), attached to the existing building by means of a <br />breezeway. (See Exhibit B) The breezeway attachment will cause these <br />structures to be considered as a single building under the terms of the <br />Zoning Ordinance. <br />Analysis: <br />The City's Zoning Ordinance allows non-conforming uses to be <br />enlarged under the following circumstances: <br />• <br />
