Enlargement of Non-Conforming Use <br />REOUESTF..D FOR: Leading Light - 401 N. 5th Street <br />(Blk. 90; Lots 17,18; La Porte) <br />REQUESTED BY: Mrs. Pdorene Swanagan & Mrs. Pauline Lewis <br />on behalf of Leading Light ~~376 O.E.S. <br />Background: <br />The Leading Light rneeting hall is an existing building located at 401 <br />N. 5th Street in an R-1, Low Density Residential Zone. The lodge is an <br />old frame building currently under restoration. There are presently no <br />kitchen or restroom facilities in this building. The 16' X 20' <br />addition the lodge is proposing will house these facilities. (Exhibit <br />No. 1) <br />The City's zoning ordinance now restricts fraternal organizations to <br />General Comriercial zones. As they have occupied this building prior to <br />ordinance adoption, the Leading Light lodge is a legally existing <br />non-conforming use. <br />• <br />Analysis: <br />The City' s zoning ordinance allows non-conforming uses to be expanded <br />under the following circumstances: <br />(1) ",,. [reconstruction, enlargement or extension of] a <br /> building occupied by a non-conforming use on the lot <br /> or tract occupied by such building, provided that the <br /> reconstruction, extension or enlargement does not <br /> prevent the return of the property to a conforming <br /> use." (Section 11-605 [a]) <br />(2) "... when the Board finds that such special excep- <br /> tion will not adversely affect the value and use of <br /> adjacent or neighboring property or be contrary to <br /> the best public in'cerest." (Section 11-605) <br />As noted above, this is a quite old frame building that is being <br />renovated by the Leading Light lodge. As part of the renova tion, the <br />building was shifted to another location on the same piece of <br />property. This eliminated an encroachrnent onto an abutting piece of <br />property and located the building within R-1 side setback li nes. The <br />proposed addition, if allowed, will also meet R-1 setback and lot <br />• <br />coverage requirements. (Exhibit No. 1) <br />
