Albrecht, Director of Community <br />Development; Ervin J. Griffith, Building Official/Zoning <br />Administrator; Nina Bergeron, Community Development Secretary; <br />John Armstrong, Assistant City Attorney <br />Others Present: R.T. Sims, property owner at 525 South 7th; <br />Teresa Sims, property owner at 525 South 7th; E.G. Clarke, <br />District 6 Representative, City Council <br />• First on the agenda was to consider approving the minutes from the May <br />12, 1933 Public Hearing and Regular Meeting. There was a motion by <br />Jody Seeger and a second by Jack Humphrey to approve the minutes as <br />presented. The vote was unanimous. <br />Next on the agenda was to consider an appeal by Mr. R.T. Sims to the <br />enforcing officer's decision regarding side yard setbacks as regulated <br />by Section 5-700, Table "B" of Ordinance #1501. <br />Staff reports that Mr. Sims carport not only exceeds the ten feet <br />(101) side yard setback required by ordinance, but also encroaches <br />four feet, six inches (4.51) into the adjacent west "E" Street right <br />of way. The City did not permit the construction of this carport. <br />Property owners within the two hundred feet (2001) area were notified. <br />Seventeen (17) notices were sent out with five (5) replies returned in <br />favor of and none in opposition. <br />Staff, in conclusion, stated that this request does not meet the <br />prerequisite requirements. Staff is recommending that the Board deny <br />this appeal. <br />After being sworn in under oath, R. T. Sims submitted fourteen (14) <br />letters (plus the five mailed in) from surrounding property owners <br />supporting his appeal along with pictures of the carport. He <br />• expressed his reasons for keeping his carport. <br />
