<br />• <br />Board of Adjustment <br />Minutes of May 10, 1990 <br />Page 3 of 4 <br />CJ <br />Joel Albrecht presented the staff's report on the <br />Special Exception Request #SE90-001. The applicant on <br />behalf of Roelof 's is Judy Nieuwenhuis, owner. The <br />Nieuwenhuis are requesting a special exception which <br />would allow the required ten (10) foot side setback <br />adjacent to a public right-of-way to be reduced to zero <br />feet and further allow the maximum lot coverage of 40~ <br />to be increased to 660. The existing building occupies <br />approximately 2,295 square feet or 38~ of the total lot <br />area. The eastern face of the building is located on <br />the property line which is the south 2nd street R-O-W <br />boundary. There is no setback from the property line <br />along the face of the building. The proposed addition <br />would extend this building line. The proposed setback <br />is in conflict with the ten (10) foot setback <br />requirement of Footnote #3 to Section 6-500, Table B. <br />Paragraph b.3 of the Zoning Ordinance Section 11-605.2 <br />states a Special Exception may be granted "to deviate <br />yard requirements in the following circumstances:. . <br />A yard exception on corner lots." Setback and lot <br />coverage, as "yard issues," are both eligible to be <br />considered for Exception under the provisions of this <br />paragraph. Under the provisions of this paragraph, the <br />applicant's request to have off street parking waived, <br />can be considered by the Board. <br />This request satisfied the pre-requisites of Zoning <br />Ordinance Section 11-605 and is therefore eligible to <br />be considered for a special exception. <br />Dr.~ Bernay swore in Judy Nieuwenhuis who is <br />representing Roelof's. Mrs. Nieuwenhuis stated to the <br />Board they wished to add on to existing Main Street <br />commercial building in a manner which is consistent <br />with typical existing Main Street r_ommercial buildings. <br />This would include side setbacks typical of Main Street <br />development, lot coverage typir_al of Main Street and <br />parking arrangements typical of Main Street. Mrs. <br />Nieuwenhuis also told the Board they were requesting a <br />reduced side yard setback adjacent to South 2nd Street <br />to zero (0) feet, increasing allowable lot coverage to <br />66~ and also to waive off street parking requirements. <br />
