This exception is being requested under the <br />provisions of Zoning Ordinance Section 11-605.2a. <br /> <br />Bartco Enterprises is a legally established nonconforming use. <br />This business became nonconforming in 1987 with the adoption <br />of Zoning Ordinance 1501. <br /> <br />Prior to the adoption of Ordinance 1501, miniwarehouse <br />storage (SIC 4225) was allowed in Commercial Zones. With <br />the adoption of the current Zoning Ordinance, this type of <br />business was restricted to the City's industrially zoned districts. <br />The age of the warehouse building is not know by staff but, <br />Exhibit A, which was prepared from a 1980 aerial photograph <br />shows the buildings in question. Houston Lighting & Power <br />utility records indicate an active business account for this <br />location since November, 1984. The age of the buildings and <br />the length of utility service verify that the business was in <br />operation prior to 1987 and is, therefore, a legally established <br />nonconforming use. <br /> <br />Mr. Stone, the present owner of this facility, on behalf of a <br />prospective purchaser, is seeking a Special Exception to allow <br />additional miniwarehouse buildings to be constructed on the <br />property.
