<br />Page 7 of 10 <br />Zoning Board of Adjustment <br />Minutes of March 24, 1994 <br /> <br />IV. <br /> <br />CONSIDER APPEAL OF THE ENFORCING OFFICER'S DECISION #A94-001 <br />WHICH HAS BEEN REQUESTED FOR THE PURPOSE OF REVERSING THE <br />DECISION OF THE ENFORCEMENT OFFICER TO DENY A LICENSE FOR <br />OPERATION OF A MOBILE HOME PARK TO BE LOCATED ON DWIRE <br />DRIVE. THE TRACT IN QUESTION IS DESCRIBED AS LOTS 1-4 AND TRACT <br />19A; BLOCK 7; BAY OAKS SUBDMSION. THIS APPEAL WAS PRESENTED TO <br />THE BOARD OF ADJUSTMENT ON FEBRUARY 24,1994. IT WAS TABLED <br />WITHOUT DISCUSSION. THE MOTION TO TABLE SPECIFIED THAT THE <br />APPEAL WAS TO BE BROUGHT UP FOR CONSIDERATION AT THE MARCH <br />24, 1994, ZONING BOARD OF ADJUSTMENT MEETING. <br /> <br />,_. <br /> <br />Mr. Harrington stated the appeal was requested by Jan Stevenson and listed in her <br />appeal as Lots 1-4; Block 7; Bay Oaks Subdivision and further described as the 200 <br />and 300 Blocks of Dwire Drive. Ms. Stevenson did not include in her appeal, Tract <br />19A as it is not a part of Block 7, however staff included it in their review since <br />Tract 19A had in the past been referenced by Ms. Stevenson. The property is zoned <br />R-l, Low Density Residential. Ms. Stevenson is appealing the decision of the <br />Building Official to deny a license for the operation of a mobile home park to be <br />located on the property. Mr. Harrington recounted all of the facts relevant to this <br />appeal. (A complete reading may be found in staffs March 24, 1994, report on A94- <br />001.) It is staffs recommendation that this appeal be denied. <br /> <br />Mr. Harrington added there were 21 notices mailed to surrounding property owners. <br />2 were returned undeliverable; 1 in favor and 4 were returned in opposition of the <br />appeal. In addition, 20 responses were received in opposition of the appeal and were <br />hand delivered on forms that had been copied and submitted by persons living <br />outside the notification area. <br /> <br />A. PROPONENTS <br /> <br />Chairman Bernay swore in J an Stevenson. Ms. Stevenson wanted to make <br />sure the Board was copied with a packet of information she had submitted to <br />Mr. Harrington on the previous day. She asked the Board to reverse the <br />decision of the Enforcing Officer. Ms. Stevenson asked to have entered into <br />the record what she referred to as Trial Stipulations together with the Exhibits <br />Referred to Therein. She added, Exhibits Rand U have not been included. <br />The exhibits are included as part of these minutes and are listed as Exhibits <br />
