Fairmont Pazkway, which is further. described as Lots 28- <br />32; ,Block 1105; Town of La Porte. <br />General Commercial (GC) <br />Mr. Rudy G. Hikary, property owner <br />Purpose of Request: The applicant is requesting a vaziance to the provisions of Zoning <br />Ordinance 1501, Sect. 10-605, Figure 10-3, which allows for a <br />maximum driveway width of twenty-five feet (25') in a General <br />Commercial . (GC) zone. The request has been made for the <br />purpose of allowing construction of a thirty-five foot (35') <br />driveway on Fairmont Pazkway and athirty-five foot (35') <br />driveway on South 4th Street. . <br />Background: As noted, the applicant is proposing to construct a new gas <br />• station/convenience store to be located at 501 West Fairmont <br />Pazkway. As proposed, the Fairmont ~Pazkway face of the facility <br />would have one thirty five foot (35') driveway. The Zoning <br />Ordinance allows a maximum twenty five foot (25') driveway in <br />a General Commercial zone. The applicant applied for two (2) <br />driveways and was denied previously. However, based on the <br />applicant's revised request, it is the opinion of staff that the 35' <br />drive would not violate the spirit of the Zoning Ordinance. <br />Based on the failure to comply with established design criteria, the <br />Enforcing Officer was obligated to deny the applicant's permit. <br />Mr. Hikary is requesting a vaziance. <br />Analysis: Zoning Ordinance Section 11-606 defines a vaziance as a <br />"deviation from the literal provisions of the Zoning Ordinance <br />granted ... when strict conformity to the Zoning Ordinance would <br />
