Also, whether granting this variance <br />will not be contrary to public interest and the spirit of this chapter is still <br />observed <br />The highest and best use of this property is recognized as industrial. <br />Therefore, the property in question has been zoned B.I. by city. The original <br />platting of the lot and block grid layout of the Town of La Porte did not <br />consider industrial or large area uses. The 125' lot depth is exceptionally <br />narrow when placed in the context of B.I. zoning. It would seem reasonable <br />and within the spirit of the zoning regulations to r~iuce a building setback <br />which is adjacent to an alley and developed commercial property. <br />Conclusion: Based on the facts and considerations noted in this report, the Board is being <br />asked to consider the applicant's variance request #V99-0Ol thus allowing a <br />five foot (5') building setback off the west property line. <br />ADDeaI3: As per Section 106-196 of the Code of Ordinances of the City of La Porte: <br />Any person or persons, joitrtly or severally, aggrieved by any decision of the <br />Board of Adjustment, or any taxpayer, or any officer, department, board or <br />bureau of~the aty may present to a court of nycoWi a petition for a writ of <br />certiorari, as provided by V.T.C.A, Local Government Code Section <br />211.011, duly verified, setting forth that such decision is illegal, in whole or <br />in part, specifying the grounds of the illegality. Such petition shall be <br />presented to the court within ten days after the filing of the decision in the <br />office of the Board of Adjustment. <br />
