O. & Carol Childs, property own~s <br /> <br />- Reauested for: <br /> <br />911 East D Street , <br />Block 43; Lots 15-23; and Block 44; Trs. 14A, 29 & 3,2; B~yfront Addition <br /> <br />Back2round: <br /> <br />On February 21, 2000 the City received a report that the residents of 911 <br />East D StI'eet had moved a metal, commerciil shippinj container onto their <br />property. Staff inve~gated the report on February 22 and found a shipping <br />contah1er had been moved onto the property without the permission of the <br />City. 'The -property _ owner asked about a possible permit to keep the <br />container. She was instructed to talk with the City's building departme~ <br />concerning this matter. The City received a permit application for this <br />address on 02-24-00. <br /> <br />A telepho~e conversation with the owners indicated they would rebuild the <br />container so it wouldn't look like a container in order to keep the container. ' <br />However, no plans were provided with the permit submittal. - Staff explajned _ <br />, by telephone and by mail that the use of a shipping container as an accessory <br />building in a residential (R-1) zone is prohibited by the City's zoning <br />regulations and a permit would not be approved. A copy of the denied <br />permit and subsequent letter is attachect for your review. (See Exhibits A & <br />B), <br /> <br />Staifdenied the permit in February, citing Section 106-741(h) that states it IS <br />unlawful for any person- to leav~ stand, or park a shipping container on any <br />property zoned for residential use. Since that time additional zoning <br />regulation changes have ~ccurred that reinforce the, desires of the Planning <br />and the Zoning Commission (p&Z) and City Council. <br /> <br />At their OCtOber 11, 1999 meeting, City Council asked the P&Z <br />Commission to ~ assess and make recommendations regarding zoning <br />requirements related - to the outside storage of shipping containers. At'their <br />December 16, 1999 meeting,' P&Z received information from staff <br />concerning this matter and directed them to make certain changes. - These <br />,changes were made and at the February 1.7, 2000 - m~eting, P&Z <br />recommended approval of zoning ordinance changes relating to the use of <br />shipping containers and fo~arded their comments to City Council for- <br />consideration. <br />
