<br />Zoning Board of Adjustmern • <br />Minutes of January 24, 2002 <br />Page 5 <br />Chairperson Grant swore in Eugene Samson, 501 Valleybrook, who awns a town <br />home on Oregon Street. Mr. Samson expressed concern there may not be enough <br />parking area. He is not sure if he is for or against the project. <br />Chairperson Grant swore in Steve Surofchek,1311 Oregon Street. Mr. Surofchek is <br />not sure if he is for or against the project. He stated there is already a parking <br />problem along Oregon Street in front of the town homes and this development may <br />take away from the residential aspect of the area. <br />Chairperson Grant swore in Dolores Baum, who currently resides in El Lago. Ms. <br />Baum hopes to one day be a resident at the complex. The senior facility across the <br />street is very convenient. There shouldn't be a problem with too many cars since <br />this is a senior's residence. <br />- B. OPPONENTS - - <br />No direct opposition was presented <br />Ms. Goodwin noted there were 27 public hearing nadces mailed The City received one <br />response in opposition, none in favor, and one was returned undeliverable. <br />Staff recommended approval of the special exception with noted conditions: <br />Motion by Rod Rothermel to approve Special Exception #02 -001 with the following <br />conditions: <br />1. Parking shall be calculated as follows: 72 units x 1.25 yields 90 spaces; plus 14 <br />ADA spaces for a total of 104 required parking spaces. <br />2. Covenants/restrictions shall be assigned to the property limiting the use of <br />the property to senior housing for a period of 114 years with the parking <br />requiremerrts proposed by the City. In order to assure that either the <br />applicant or subsequent purchasers of the property cannot change the use, <br />restrictive covenants/restrictions shall be filed affecting the property that <br />would limit the use to the senior apartment project for the proposed 114 years. <br />No certificate of occupancy or zoning permit shall be issued untr3 the deed <br />restrictions, in form satisfactory to the City and the City's Attorneys, have <br />been f>7ed for record, thus limiting the use of the property. <br />3. Identification of the Special Exception information (permit number, date of <br />passage and any conditions) shall be noted on the minor development site <br />plan. This must be submitted to the city prior to approval and issuance of a <br />bur~ding permit. <br />Second by Bob Capen. Motion carried with all in favar. <br />
